The Federal Circuit and Family Court of Australia has the power to deal with Property (traditional, assets, superannuation and even debts).

There are a number of areas that need to be understood about how the law will view your particular case. Everyone has a different story which is why the advice a friend received for family law may be very different from the advice you receive.

Some of the steps that are taken to ascertain your property settlement are as follows:

  • Identifying the entire pool of what you and your partner own and owe

  • Looking at other contributions to the relationship which may or may not be in a monetary form, such as gifts and inheritances or contributions to the welfare of the family

  • Considering any future needs that may be impacted by a persons age, health, financial resources, care of children and ability to earn an income

You have 2 years from the date of separation to finalise your property settlement where you were in a defacto relationship or 12 months from date of divorce if you were married.

It's important to finalise your property settlement and draw a financial distinction between you and your partner.
