Collaborative law is a relatively new way of resolving your family law matter where both parties make a commitment to resolve their family law matter and not go to court.

The process involves a series of face-to-face round table conferences between the parties, their lawyers and a third-party facilitator who is a collaboratively trained professional.

The difference between the Collaborative process and a traditional approach is the manner in which negotiations progress between the parties. Instead of back and forth correspondence between solicitors, the collaborative law process is aimed at reducing correspondence to a minimum as the solicitors and parties discuss all issues, and possible resolutions, during round table conferences. This allows you to take an active part in the negotiation process compared to what would ordinarily occur in a traditional forum.

A key feature of Collaborative practice is that both parties, their lawyers and the facilitator sign a participation agreement committing that the process is confidential and that each of the parties will not commence proceedings in Court. If negotiations break down and litigation is required to progress the matter to a resolution then each of the lawyers engaged in the process is disqualified from continuing to act on behalf of the parties.

  • The parties can set their own timetable to the negotiations

  • It can be far quicker and more cost effective;

  • There is greater transparency in the process

  • You can engage relevant experts as required. For example, feedback from psychologists, accountants and financial planners
