Separation is a stressful time for children as it may mean a change to their usual arrangements

 

When considering what arrangements to put in place, it is important that parents consider the following factors:

  • That children continue to have a meaningful relationship with both parents as well as other family members

  • Both parents continue to be involved and consult with one another about big decisions that impact a child such as health, education, religious affiliation and where a child lives in so far that a change of residence impacts the time a child spends with the other parent

  • Children are protected from family violence, abuse, neglect or any other risk of harm.

Prior to seeking the assistance of the Court, parents are required to demonstrate that they have made a genuine attempt to resolve their dispute via less adversarial means, such as mediation with an accredited Family Dispute Resolution Practitioner.

This requirement is not necessary where there is an urgent parenting issue
