Relocation is a complex issue when considering parenting arrangements

 

As a general rule, a parent cannot relocate with a child without the consent of the other parent.

If parties are unable to agree about one parent moving with children they will require a Court Order to do so. In determining whether to permit a parent to relocate, the Court will focus on the best interests of your child.

We have acted for parties seeking to relocate as well as the parent left behind. We have advised clients on interstate, international and more local relocations such as within New South Wales and the Sydney Metropolitan Area.

While we endeavour to assist parties negotiate regarding a proposed relocation sometimes agreement is not possible and the matter needs to be determined by the Court. In those circumstances, we have continued to act on behalf of clients up to the final hearing of their matter.

Relocation Applications are complex parenting cases as the Court is required to balance one parents desire to relocate against the right for a child to continue to have a meaningful relationship with the left behind parent.
